EXECUTIVE ORDER NO. 4 TO:
ALL BOARDS, COMMISSIONS, DEPARTMENT HEADS, AND ELECTED OFFICIALS FROM:

28, 1994 SUBJECT: UTILIZATION OF DETROIT-BASED BUSINESSES
AND SMALL
BUSINESSES Approximately
a year and a half ago, the City of Detroit ordinance establishing the City's
race-and gender-based sheltered market program was found unconstitutional by
the United States District Court in the aftermath of the United States Supreme
Court's decision in City of Richmond v. J.A. Croson.
As a result, the City was forced to abandon that program, which had set aside
specific percentages of City contracts for minority-owned businesses and women-owned
businesses. The provision of jobs
to Detroit residents, as well as the success of Detroit-based businesses and small
businesses, nevertheless, are paramount goals of this administration.
City government has a significant interest
in encouraging the creation of employment opportunities for its residents and
in fostering the success of its resident businesses. Furthermore, because
City government is a major purchaser of goods and services, it has an opportunity
to play a major role in the economic revitalization of the City. This City's
budget for this fiscal year is $2.2 billion, a substantial percentage of which
will be used to acquire goods and procure services to equip the City to serve
the needs of its citizens. Moreover, the City itself stands to gain from
improvements in expanded job and business opportunities for Detroit residents
and businesses through the additional tax revenues thereby generated.
It is the policy of this administration to
develop opportunities for small and local businesses where possible, except as
limited by the Charter of the City of Detroit. The purpose of this Executive
Order is to direct City departments and agencies to implement specific purchasing
goals for Detroit-based businesses and small businesses. The goal of this
administration is to award thirty percent (30%) of the total dollar value of all
contracts let by the City to Detroit-based businesses and small businesses, recognizing
that the ability of individual departments to achieve this goal may vary as a
function of the types of goods or services required and the availability of local
and/or small businesses to perform and given contract.
For the purposes of this Executive Order, "Detroit-based" has the meaning
assigned to it by Section 18-5-1 of the Detroit City Code, as follows:
Detroit-based shall mean the physical and economic relationship
to this city determined by the the payment
of city income taxes on the contractor's
net profits, city excise taxes, and city
property taxes on a plant or office and equipment such as is
ordinarily required for the performance of the contract bid upon
or on other real or personal property in the city equivalent in
value to such plant or office and equipment, for not less than
one taxable year immediately prior to the date of determination.
The term "small business" shall have that meaning assigned to it by
the Finance Department based on the federal Small Business Administration's regulations
and local economic conditions in and surrounding the City of Detroit.
This Executive Order is effective immediately.
The Finance Director is hereby directed to prepare administrative guidelines for
the implementation of this Executive Order within thirty (30) days. The
administrative guidelines shall become effective within thirty (30) days of the
date of this Executive Order. All
City departments and agencies are directed to identify suitable contracts and
subcontracts for Detroit-based businesses and small businesses, and to review
their contracting practices and procedures for implementation of this Executive
Order. Responsibility for monitoring and enforcing the provisions of this
Executive Order is committed to the Finance Department and such other City Departments
that the Mayor may from time to time designate.

EXECUTIVE ORDER NO. 14 TO:
ALL BOARDS, COMMISSIONS, DEPARTMENT DIRECTORS, CITY
COUNCIL MEMBERS, AND THE CITY CLERK SUBJECT: CERTIFICATION
OF MINORITY AND WOMEN-OWNED
BUSINESS ENTERPRISES DATE: JUNE
18, 2001 As the revitalization
of Detroit progresses, the City will continue to be the focus of significant new
economic development projects. It is the policy of this Administration to encourage
and enhance, whenever possible, the participation of business enterprises owned
by minorities and women in those projects.
To facilitate the use of Minority-owned Business Enterprises (MBEs) and Women-owned
Business Enterprises (WBEs) by developers, the City of Detroit, through its Human
Rights Department, will begin identifying and certifying MBEs and WBEs, along
with the current Detroit-Based and Small Business certifications. Ultimately,
this certification process will produce a roster of such businesses that will
be made available to developers as part of the City-Certified Business Register,
which already includes Detroit-Based and Small Businesses.
The M/WBE certification process is not a City set-aside or quota
program for award of City contracts to MBEs and WBEs. Rather, the Register is
a viable tool for businesses and developers alike as well as others, for
identification of Detroit-Based Businesses, Small Businesses, MBEs and WBEs which
they may wish to engage in business transactions. The Human Rights Department
will develop and implement appropriate guidelines for the MBE and WBE certification
process and publication in the City-Certified Business Register. However,
key aspects of the City's MBE and WBE certification requirements are at least
fifty-one percent (51%) bone fide ownership of the business enterprise
by minorities or women, and control by minorities or women of the direction. policy
and overall operations of the business.
The City will make the Register available to both the public and private sectors.
We hope that it will contribute to the formation of business relationships that
will yield substantial benefits not only to the parties involved but throughout
the greater Detroit community. This
Executive Order is effective this date.

29, 1983 EXECUTIVE ORDER NO. 22 TO: THE
HONORABLE CITY COUNCIL
HEADS OF DEPARTMENTS
BOARDS AND COMMISSIONS SUBJECT: EMPLOYMENT OF LOCAL LABOR ON PUBLICLY
FUNDED
CONSTRUCTION PROJECTS No city has suffered more economic devastation
as a result of the national recession than Detroit. Our unemployment
rate remains one of the highest in the nation, producing an unacceptable level
of deprivation, hunger, malnutrition and infant morbidity and mortality.
Nothing is more important to the economic revitalization of Detroit than
providing jobs to the residents of Detroit. There is very little wrong
with this city that would not be cured by a job for every man and woman who
wants to work. At a time when unemployment has had such a devastating
effect on our city, it is imperative that we do all that we can to alleviate
the joblessness we find in Detroit. There is a particularly high
rate of unemployment and underemployment for Detroit residents who work in
the construction industry and subcontracted trades. Publicly
funded construction projects in the city are substantially supported by money
derived from Federal, State and City taxes. It is important that we
assure that those funds which are returned to Detroit are used to provide
the maximum benefit for Detroit. More specifically, construction projects
in Detroit or for the City's benefit should, so far as is possible, provide
jobs for the residents of this City. Detroit residents have a right to expect
an opportunity to hold jobs generated by publicly funded construction projects
involving the City. Therefore, I do hereby order that the following policy
take effect as of November 1, 1983:
On any construction project funded in whole or in
part by the City, or State or Federal funds, the
worker hours shall be performed by not less than 25%
minorities and at least 5% women. Where possible,
these percentages shall be applied on a craft-by-
craft basis. For purposes of this paragraph,
worker hours shall include work performed by
persons filling apprenticeship and on-the-job
training positions. I am also directing the Finance Director to prepare
for my final review and approval appropriate administrative guidelines to
implement this Order while assuring minimum delay in the completion of City
publicly funded construction projects. The Finance Department and other
City Departments which I may from time to time designate shall be responsible
for monitoring and enforcing the provisions of this Executive Order.
